Spilbridge help AS Ventbunkers to lift illegal provisional measures achieved by LITASCO SA

In an attempt to prevent Ventbunkers from exercising the right of retention over certain Litasco’s fuel oil at the terminal of Ventbunkers, in June 2011 Litasco obtained provisional measures against Ventbunkers. Over 40’000 MT of Litasco’s fuel oil at the terminal of Ventbunkers were attached by an order of the Riga Regional Court.

Acting for the benefit of Ventbunkers, Spilbridge were successful in most of the proceedings against the court bailiffs enforcing the order. Moreover, the Supreme Court found that the provisional measures were imposed unlawfully and in January 2012 they were lifted with immediate effect. The Supreme Court have also been somewhat critical about the prospects of the claim brought by Litasco.
